Online Event Prize Drawing Rules & Conditions
1. Eligibility.
The drawings are open only to legal residents of the United States who are eighteen (18) years of age or older. Residents of New York, Florida, and Rhode Island are not eligible to participate. Only individuals who attend the online event hosted by SmartBrief and who are present at the time of the drawings are eligible to win. Eligibility to participate in the drawings is void wherever prohibited or restricted by law. Duplicate or more entries are disqualified and voided. SmartBrief reserves the right to deny admission of any individual to a webinar who has in the past or is presently interfering with the operation or delivery of any portion or component of an online event (including the any component of a drawing). Such interference is a violation of these official rules.
2. No Purchase Necessary
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THE DRAWING. Purchasing services from SmartBrief will not improve your chances of winning. There is no cost to attend the online event hosted by SmartBrief.
3. Entry.
To enter the drawings, you must register for the online event hosted by SmartBrief prior to its advertised start date and time, and you must attend the online event hosted by SmartBrief and be present when the winners are announced.
4. Odds.
The odds of winning depend on the number of eligible registrants entered and present for the drawings.
- A. Grand Prizes. The odds of a particular entry being selected as a winner of a grand prize are: one (1) out of the total number of registrants entered and present.
- B. Gift Cards. The odds of a particular entry being selected as a winner of a gift card are: one (1) out of the total number of registrants entered and present.
- C. ‘Best Question’ Gift Card Prizes. The odds of a particular entry being selected as a winner of a best question gift card are: one (1) out of the total number of registrants who submit questions as deemed valid by Actual Tech Media and who are present during the event.
5. Drawings.
The drawings will take place at SmartBrief’s offices in Bluffton, South Carolina, on the advertised date of the online event hosted by SmartBrief, and the winners will be announced to the audience throughout the online event hosted by SmartBrief. The winners will be selected by or under the supervision of SmartBrief, in its sole discretion, in random drawings from all eligible entries. SmartBrief is not responsible for any technical difficulties during the online event hosted by SmartBrief or drawings.
- A. Grand Prizes. The winners of the grand prizes will be selected in random drawings from all eligible registrants entered and present at the time of the drawings.
- B. Gift Cards. The winners of the gift cards will be selected in random drawings from all eligible entries, which include one (1) entry per eligible registrant entered and present at the time of the drawings and one (1) entry per eligible tweet made prior to the time of each drawing.
- C. ‘Best Question’ Gift Cards. The winners of the gift cards will be selected in random drawings from all eligible entries, as deemed valid by SmartBrief, which include one (1) entry per eligible registrant entered and present at the time of the drawings.
6. Prizes.
Expenses not specifically provided for in these Official Rules are the sole responsibility of the winners. All federal, state and local taxes and duties are the sole responsibility of the winners. The prizes may not be transferred, substituted or redeemed for cash, except that SmartBrief may substitute a prize of equal or greater value due to prize availability.
7. Delivery.
If you are selected as a winner, SmartBrief will contact you at the email address you provided with your online event registration, and you will need to provide an address where the prize may be delivered. SmartBrief may retain a third party to handle prize delivery and you agree that SmartBrief may provide them with your contact information. SmartBrief is not responsible for missing, damaged, broken, lost, stolen, or misdirected prizes.
8. Release of Name; Affidavit of Eligibility.
By entering the drawings, you agree that if you are selected as a winner SmartBrief may release your name, on a list of the winners’ names, upon request to participants or as otherwise legally required. A winner may be required to sign and return an affidavit of eligibility, or the prize may be forfeited. The winners may be requested to sign a publicity release; however, execution of a publicity release is not required to accept a prize.
9. Modification of Drawing.
SmartBrief reserves the right in its sole discretion to cancel or modify the drawings if the drawings’ integrity is compromised in any way, and it may select winners from eligible non-suspect entrants. All federal, state and local laws and regulations apply.
10. Bound by Rules.
By entering the drawings, you fully and unconditionally agree to be bound by these Official Rules and the decisions of SmartBrief, which will be final and binding in all matters relating to the drawings. Failure to comply with these Official Rules may result in disqualification from the drawings. SmartBrief reserves the right to verify the eligibility of entrants and to disqualify permanently from the drawings any entrant it believes has violated these Official Rules.
11. Use of Data.
SmartBrief will collect personal data about entrants in accordance with its privacy notice. Please review SmartBrief’s privacy notice here. By participating in the drawings, you agree to SmartBrief’s collection and usage of your personal information and you acknowledge that you have read and accepted SmartBrief’s privacy policy.
12. Release by Entrants.
By participating in the drawings, you agree to release, discharge, and hold harmless SmartBrief, and its parents, affiliates, subsidiaries, advertising and promotional agencies and their respective members, officers, directors, employees and agents, from any liability, claims, losses, and damages arising out of or relating to these prize drawings, including without limitation your participation in the online event hosted by SmartBrief and the drawings.
13. Release by Winner.
By accepting a prize, each winner agrees that SmartBrief and its parents, affiliates, subsidiaries, advertising and promotional agencies and their respective members, officers, directors, employees and agents will have no liability or responsibility for, and they will be held harmless against, any injuries, damages or losses of any kind to any person (including death) or property resulting in whole or in part, directly or indirectly, from the entry, receipt, acceptance, possession, use or misuse of the prize. If a winner executes a publicity release, the winner agrees, where lawful, that SmartBrief may use the winner’s name, likeness, biographical information, voice, and statements attributed to winner (if true) for publication, advertising and promotional purposes, without consideration.
14. Choice of Law and Venue; Arbitration.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants and SmartBriefin connection with the drawings, shall be governed by, and construed in accordance with, the laws of the State of South Carolina, without regard to its conflict of law provisions, except as to matters relating to arbitration, which shall be governed by the Federal Arbitration Act. Any dispute arising out of or relating to the drawings or any prize will be decided only by arbitration, individually and not on a class-wide basis. Any arbitration will be administered by the American Arbitration Association and will take place in Beaufort County, South Carolina. Any and all claims or awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the drawings, but in no event attorney’s fees; and under no circumstances will an entrant be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
